Can you reverse what you did, then use Akeeba Backup and Kickstart to move the site (or follow the other method in this documentation - it sounds like that's what you did but check this doc anyway in case there's something you missed - https://docs.joomla.org/Copying_a_Joomla_website
Was the copied site set up with a new database, that is, did you export the database from the original site, and import it to a new database, then update configuration.php on the copied site to point to the new database (as outlined in the documentation above)?
I did not setup a new database. the sites are on the same server and have access to the same database.
Menu items work fine ie, https://development.domain.html/category/site.html
original site is https://www.domain.html/cms/category/site.html (this still works fine)
I don't know why changing the path would cause an issue with permissions, but maybe it does.
